PROBLEM/ISSUE STATEMENT
The City of Billings conveyed Lots 1-6 Block 53, Fosters Addition to the Stockman Bank in 2006. Earlier this year, the City agreed to sell lots 7 & 8 to the Bank. The Bank temporarily occupied a portion of Lot 7 when it demolished the buildings that stood on Lots 1-6 and may need to occupy the property again before acquiring the additional lots from the City. Staff proposed creating a temporary property easement for the Bank so that it could accept responsibility for its own actions on the property, indemnify the City and provide insurance. The attached easement accomplishes those purposes, and staff recommends that the Council approve it.
ALTERNATIVES ANALYZED
The City Council may approve or reject the easement. Accepting it puts the Bank into its proper position of indemnifying and insuring the City in the event that it or its contractor damage property or cause injuries.
FINANCIAL IMPACT
There is no direct financial impact to the City.
RECOMMENDATION
Staff recommends that the City Council approve an easement on Lots 7 & 8, Block 53, Foster's Addition for the Stockman Bank's temporary demolition and construction activity on the adjacent lots.
