PROBLEM/ISSUE STATEMENT

 Yellowstone County and the City’s Public Works Department mutually agree that the County should quitclaim deed to the City, a parcel known as Zimmerman Trail South Park in the Durland Heights Subdivision.  This parcel is currently undeveloped.  The entire subdivision was annexed into the City in the 1950’s with the exception of this parcel.  This parcel will be used by the Public Works Department to increase the size of the existing turnaround area for City maintenance vehicles.  The parcel will also be used for a stormwater detention area for runoff from Zimmerman Trail.  The Yellowstone County Park Board approved the transfer of this property to the City and the County Commissioners approved this transfer at their August 1, 2017 meeting

ALTERNATIVES ANALYZED

City Council may accept or not accept the quitclaim deed from Yellowstone County for this parcel.
  • Accepting the quitclaim deed will allow this parcel to be used by the City for stormwater and maintenance activities.
  • Not accepting the quitclaim deed will not allow the Public Works Department to use this parcel.  There are no other viable parcels adjacent to Zimmerman trail for these maintenance needs.

FINANCIAL IMPACT

The quitclaim deed states that Yellowstone County does hereby convey, demise, release and forever quitclaim unto the City of Billings, all right, title and interest in and to the property for and in consideration of the sum of one dollar and other valuable consideration.

RECOMMENDATION

Staff recommends that the City Council accept the quitclaim deed from Yellowstone County for the Zimmerman Trail South Park, located in the Durland Heights Subdivision.
