PROBLEM/ISSUE STATEMENT

The final plat for the Amended Lot 6, Block 21 Sunnyside Subdivision, 4th Filing, is being presented to City Council for approval. On May 8, 2017, the City Council conditionally approved this preliminary plat which will create 2 lots from a 0.96 acre parcel of land.  The parcel is generally located on the northeast corner of North 27th Street and 12th Avenue North.  The subject property is legally described as Lot 6, Block 21, Sunnyside Subdivision, 4th Filing and is zoned Community Commercial.  This subdivision is proposed to be for commercial and professional office uses.  The owner is Rimrock Inn, LLC and the representing agent is Performance Engineering.  Upon City Council approval, these documents are appropriate as to form for filing with the Clerk and Recorder.

ALTERNATIVES ANALYZED

The City Council may approve or disapprove the final plat of Amended Lot 6, Block 21, Sunnyside Subdivision 4th Filing. If the City Council chooses to deny the final plat, it must base the denial on the criteria outlined in MCA 76-3-611 and BMCC Section 23-307.

FINANCIAL IMPACT

If the City Council approves the final plat, the newly created lots may be sold separately and developed, increasing the tax and assessment revenues for the City while also generating service demands.

RECOMMENDATION

The applicant has met all conditions of approval, therefore, staff recommends that the City Council approve the final plat of the Amended Lot 6, Block 21, Sunnyside Subdivision, 4th Filing.
