PROBLEM/ISSUE STATEMENT
At its meeting on May 24, 2010, the City Council conducted a public hearing and approved first reading of an ordinance amending the solid waste regulations found in Section 21-200 of the Billings City Code. In an effort to keep the city code current, public works staff has been working with the Deputy City Attorney to amend the existing city code for a wide range of issues as shown in the proposed ordinance.
ALTERNATIVES ANALYZED
City Council may:
• Approve the ordinance revisions; or
• Not approve the ordinance revisions; or
• Modify the revised ordinance upon second reading.

FINANCIAL IMPACT
There are a number of fiscal subsections in Section 21 of the city code. Two subsections of note are: Section 21-229 states that the city council shall annually determine charges for solid waste services rendered. This process has been in place for some time and will continue. Section 21-217 – Load Security, has been modified to provide a fine of $35 for vehicles within the city or between the city and the city landfill disposal site, transporting material or refuse of any kind or nature that is not fully secured. The existing code separates the vehicles by type and fines.
RECOMMENDATION
Staff recommends that the City Council approve the proposed ordinance revisions to city code section 21 as presented.
