Public Hearing and Resolution Authorizing the Sale of 0.014 Acres to the State of Montana at Highway 3 and Zimmerman Trail

PROBLEM/ISSUE STATEMENT

 The City of Billings is the legal owner of land on the east side of Zimmerman Trail between Rimrock Road and Highway 3.  The Parks, Recreation and Public Lands Department (PRPL) maintains this parcel of land.  The property consisting of 0.014 acres is intended to be sold to the Montana Department of Transportation (MDT) and will be used for the construction of the MDT intersection roundabout project located at Zimmerman Trail and Highway 3.   As required by City Code Section 22-900, staff advertised for a public hearing on February 12, 2018 and notified property owners within a 300 foot radius of this public hearing.  Staff also published a public hearing notice in the Yellowstone County News on January 26, February 2, and February 9, 2018.  The City Council must conduct a public hearing and then may consider approving a resolution selling this property to MDT.

ALTERNATIVES ANALYZED

City Council may:
 
  • Approve the resolution selling the property to MDT for $2,180, or;
  • Do not approve the resolution resulting in delaying the intersection project or causing the project to be redesigned.

FINANCIAL IMPACT

 MDT will compensate PRPL $2,180 for this property.  MDT stated that the offer is based on the current fair market value appraisal of this property considering any effect the intersection improvement project will have on this property.  This appraisal was determined by a qualified appraiser for MDT.

RECOMMENDATION

Staff recommends that the City Council conduct a public hearing, approve the resolution that authorizes selling this property to MDT for $2,180 and authorize the Mayor to sign all documents required for this sale.
