PROBLEM/ISSUE STATEMENT
The Engineering Division has a street reconstruction project planned for Midland Road in the summer of 2018. The project plan includes installing street lights along those portions of Midland Road that do not already have street lighting and retrofitting the existing lights with LED's. Council passed a Resolution of Intention to Create SILMD 324 and to discontinue SILMD 287 at its January 22, 2018, meeting and set a February 12, 2018 public hearing on the proposed district. Legal notice of the proposed district and public hearing was published and was mailed to all property owners in the proposed district in accordance with State law.
The new lighting will use steel mastarm style poles with LED lamps and underground wiring. The cost of installing the new lighting will be paid for with funds from the South Billings Boulevard Urban Renewal District (SBBURD). The adjacent property owners will only pay for electrical energy and maintenance, through an assessment on their property.
The deadline for written protests is Monday, February 12, 2018 at 12:00 p.m. The number and percentage of valid written protests received will be reported at the February 12 Council meeting. As provided in State law, the City Council has the authority to create the district if the legal protest does not exceed 50%.
ALTERNATIVES ANALYZED
• Pass the Resolution creating SILMD 324 to provide a source of funding for operation and maintenance of the streetlights; or
• Do not pass the Resolution creating the district. If the Council does not adopt the Resolution, the property owners cannot be assessed for operation and maintenance of the streetlights and the new lighting will not be installed.
