The Montana Department of Transportation (MDT) will have a project on 27^th Street from Interstate 90 to Highway 3 near the airport. This project will mill the existing pavement followed by a pavement overlay. The project will also include some ADA and sidewalk improvements.  All existing signals and illumination will be replaced with this project. The intent of the project is to extend the life of the roadway and provide pedestrian facilities to meet ADA requirements where possible. MDT is currently acquiring property, temporary construction easements and a permanent easement for the ADA work, sidewalk work and signal work for that project.  MDT desires to acquire property and easements from portions of four separate parcels owned by the City and managed by different departments. A summary sheet for these parcels is attached. Air photos highlighting the parcel locations are also attached. 
 
As required by City Code, Section 22-900, staff advertised for a public hearing on February 26, 2018, and notified property owners within a 300 foot radius of this public hearing. Staff also published a public hearing notice in the Yellowstone County News on February 9, 16 and 23, 2018. The City Council must conduct a public hearing and then may consider approving a resolution selling this property and providing these easements to MDT.

City Council may:

• Approve the resolution selling the properties and providing the easements to MDT, or;
• Disapprove the resolution resulting in delaying the project or causing the project to be redesigned.

The total compensation from MDT to the City will be $28,850 for the four properties, the three temporary construction easements and the permanent easement. Note that the compensation for Parcel No. 47 will be split between the City and four private entities having interest in the parking garage property at the northeast corner of North 27^th Street and 1^st Avenue North.  MDT stated that the offer is based on the current fair market value appraisal of this property considering any effect the improvement project will have on this property. This appraisal was determined by a qualified appraiser for MDT.
