Warranty Deed for Right of Way for Monad Road

PROBLEM/ISSUE STATEMENT

The developer of Lot 1, Block 1 Lenhardt Square Subdivision has submitted an exempt plat splitting off a road tract for Monad Road.  The developer is deeding this tract, 1B, to the city which requires the city to accept a warranty deed.  The developer will be required to construct Monad Road in the future to city standards.   Attached is a copy of the exempt plat and the warranty deed.  Monad Road is part of the Lenhardt Square master plan.  The alignment of the streets were master planned but not dedicated to the city until lot development.  

ALTERNATIVES ANALYZED

Council may:

  • Accept the warranty deed for Monad Road.  Monad Road is master planned at this location and is classified as a collector street; or
  • Do not accept the warranty deed.  This would require Monad Road to be constructed as a private road. 

FINANCIAL IMPACT

There is no significant financial impact with acceptance of the warranty deed. 

RECOMMENDATION

Staff recommends Council accept the warranty deed for the street tract for Monad Road.
