PROBLEM/ISSUE STATEMENT
On October 16, 2018, Sanderson Stewart, agent for the LDS Church, applied for an amendment to the Subdivision Improvement Agreement (SIA) specifically related to the phasing of improvements for Lots 1A, 1B and 1C, Block 6 of Parkland West Subdivision. These lots are part of an existing planned development for a church and single family residences. There are just the 3 lots included in this SIA. The subject property is generally located on the northeast corner of Monad Road and South 36th Street West. The property is PD with underlying zoning of Residential-9600 (R-96).
ALTERNATIVES ANALYZED
City Council may: Approve of disapprove of the proposed changes to the SIA.
BACKGROUND
Parkland West Subdivision, 1st Filing, Amended Lot 1, Block 6, received final plat approval on January 17, 2001. Before the subdivision, there was a conditionally approved special review to allow for a church and softball fields with residential to the north on the property (April 24, 1995). On May 8, 1995, a zone change was approved changing the property from PUD Public to PUD Residential 9600. At that time, there were plans to build a church on the northeast corner on Lot 1B with Lot 1C as future ball fields and open space. Lot 1A was to be developed as single family residential. The current SIA requires infrastructure installation with ‘development’ of Lot 1C. This lot does not have any proposed uses that would require access off of Rachelle Circle. Rachelle Circle runs between Lots 1B, 1C and Lot 1A. There will be no roads into Lot 1C for access to individual houses or need for water and sewer lines into Lot 1C. Lot 1C, when it is developed into sports field and open space, will only be required to handle storm water on site.
The changes requested in the SIA phasing will put Lot 1C in phase 1 which was the construction of the church building and combine phases 2 and 3 into a single phase 2. Phase 2 will now be Lot 1A which is future residential lots. It would be anticipated that this lot will either be subdivided in the future or developed as a single lot with multiple homes on it. The future developer will be required to complete the extension of the water and sewer lines and complete the construction of Rachelle Road with approved fire hydrants along the remaining length of Rachelle Road. See attached proposed changes to the SIA. The specific proposed changes are on pages 3 through 8. Also, attached is Exhibit A that shows the affected properties and future plans for the land. Approval of the changes to the SIA do not include approval of the proposed parking lot expansion.
Planning staff requested comment from divisions affected by the proposed changes in the SIA. There were no concerns expressed by anyone and the needed improvements will be installed when Lot 1A is developed for residential uses in the future.

FINANCIAL IMPACT
If the City Council approves the amended SIA, at sometime in the future Lot 1A may further develop under private ownership, resulting in additional tax revenues.
RECOMMENDATION
Staff recommends approval of the amended SIA phasing plan of Lots 1A, 1B and 1C, Block 6 of Parkland West Subdivision, 1st Filing to the City Council.
