PROBLEM/ISSUE STATEMENT
| The stormwater pipeline for the W.O. 18-30 City-County Drain Mitigation Project will cross through Marte Nelson's property. An easement between the City of Billings and Marte Nelson Trust is needed to allow for the construction and maintenance of the stormwater pipeline. An appraisal was completed for the parcel and the property owner was offered the appraised value plus 5% in exchange for an easement. The appraisal and an exhibit showing the easement are attached to this memo. |
ALTERNATIVES ANALYZED
City Council may:
- Approve the easement, or;
- Disapprove the easement. If the easement is not approved, the drain cannot be constructed and stormwater from the city will not drain to the river during much of the year.
FINANCIAL IMPACT
An appraisal of the parcel was completed and the value of the easement was determined to be $15,950. City code authorizes the City to pay 5% above appraisal which would be $16,747.50.
RECOMMENDATION
Staff recommends Council approve the easement for the Marte Nelson Trust property in the amount of $16,747.50.
