PROBLEM/ISSUE STATEMENT
The final plan for Danube Court Manufactured Home Park is being presented to Council for approval. On September 21, 2009, the City Council conditionally approved the Danube Court Manufactured Home Park to allow 62 spaces for manufactured homes on approximately 9.72 acres of land. The subject property is located east of Bench Boulevard off of Cherry Creek Loop in the Billings Heights. The property is zoned Residential Manufactured Home (RMH) and is adjacent to the Cherry Creek Manufactured Home Park. Cherry Creek Development, Inc. is the owner, and Sanderson Stewart is the representing agent.
The Planning Division and other applicable City Departments have reviewed this final site plan and find that it and the supporting documents conform to the conditions of preliminary approval and comply with MCA 76-3-611 and BMCC Section 23-307. Since this is a subdivision for rent or lease and no new parcels are being created, a subdivison improvement agreement (SIA) and site plan are the documents that must be recorded for this project. Upon City Council approval, the plan and SIA are appropriate as to form for filing with the Clerk and Recorder.

ALTERNATIVES ANALYZED
The City Council may approve or deny the final plan and SIA of Danube Court Manufactured Home Park. If the City Council chooses to deny the final plan and SIA, it must base the denial on the criteria outlined in MCA 76-3-611 and BMCC Section 23-307.
FINANCIAL IMPACT
If the City Council approves the Danube Court Manufactured Home Park the property will be utilized for manufactured housing and more tax revenues may be generated for the City.
RECOMMENDATION
Staff recommends that the City Council approve the Danube Court Manufactured Home Park and approve of the filing of the Subdivision Improvement Agreement and Site Plan Exhibit.
