PROBLEM/ISSUE STATEMENT
The Howard Heights Storm Drain project was approved by Council at its July 26, 2010, meeting. As part of the project, a private residential lot (Lot 1, Block 3, Howard Heights Subdivision) should be purchased to provide for added detention pond capacity, access to an oil/water separator which will help keep contaminants out of the storm drain system and room for a future pedestrian trail through the park. Attached is the warranty deed which is the conveyance method for acquiring the lot. Once approved by Council, staff will purchase the lot for the negotiated price and record the warranty deed.
ALTERNATIVES ANALYZED
• Purchase Lot 1, Block 3, Howard Heights Subdivision as part of the Howard Heights storm drain project; or
• Do not purchase the lot and redesign detention pond and access route to oil/water separator.

FINANCIAL IMPACT
Based upon an appraisal by The Appraisal Group and negotiations with the lot owner, the City is offering to purchase Lot 1, Block 3, Howard Heights Subdivision for $24,150.93. As this is part of an existing storm drain project, funds to purchase the lot will be paid for through storm drain funds.
RECOMMENDATION
Staff recommends that Council approve purchasing Lot 1, Block 3, Howard Heights Subdivision in the amount of $24,150.93.
