RECOMMENDATION
Staff recommends Council approve the purchase of playground equipment for Rose Park from LSI in the amount of $247,574.80 and from Berliner for $27,218.20, for a total purchase cost of $274,793.00.
BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)
The playground equipment at Rose Park has reached the end of its useful life and needs to be replaced. Council approved $270,000 for this purpose and in June of 2019 PRPL was awarded a $150,000 Land Water Conservation Fund (LWCF) grant that requires a 50/50 funding match and which can only be used for the Rose Park play equipment. The total funding budget is $420,000. Staff intends to use the State of Montana Cooperative Purchasing Program to purchase the equipment. The Cooperative Purchasing Program negotiates a discounted price with vendors, enabling municipalities to purchase items directly from approved vendors in lieu of the traditional bidding process.
The department engaged the community and increased public input through a voting contest that allowed community members to view a series of playground design layouts and cast a vote for the ones they liked best. Staff selected and developed two playground layouts for each of the 3 pods that will contain new playground equipment. The voting contest allowed citizens to participate directly in the playground selection process and shape the final playground design. Links for community members to vote were located on our website and department Facebook page. We received over 700 votes in the contest and the winning choices from each pod comprised the final playground layout design. See Attachments (Pod #1, Pod #2, and Pod #3). The equipment will be purchased from 2 vendors, Landscape Structures Inc. (LSI) and Berliner. These vendors are manufacturers of play equipment nationally and internationally meeting all industry and federal standards. The major portion of equipment will come from LSI in the amount of $247,574.00 and the remaining equipment from Berliner in the amount of $27,218.20. Staff is seeking Council approval for the purchase of this equipment.
The remaining funding will provide for sub-surface drainage, fall protection, play equipment installation, concrete curbing, and accessible sidewalk.

ALTERNATIVES
City Council may:
- Approve purchasing the LSI playground equipment for $247,574.80 and the Berliner equipment for $27,218.20, or;
- Disapprove the purchase and provide guidance to staff.
FISCAL EFFECTS
Originally this project was budgeted in FY18, but was delayed until the grant was awarded. City Council approved the grant agreement at the 7/22/2019 meeting. The matching funds budgeted in FY18 have been held within Park District 1, and are available for this project. Upon approval of this purchase, a budget amendment will be needed to re-appropriate the funds for FY21, now that the grant has been awarded.
