RECOMMENDATION
Staff recommends that City Council approve the resolution to amend the boundaries of Street Improvement Light Maintenance Districts (SILMDs) 14, 97, and 99, and discontinue SILMD 248.
BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)
St. Vincent Health Care took ownership of two lights in SILMD 14 along N. 28th Street, north of 11th Avenue so these lights would correspond with their other privately owned lights. These lights provide illumination for twelve parcels (Block 9, Lots 25 through 48, see attached Resolution) that need to be removed from SILMD 14 as these parcels no longer benefit from any lights in SILMD 14.
The State of Montana is currently improving 27th Street from the I-90 Interchange to Rimrock Road. These improvements include removing existing NorthWestern Energy owned and maintained lights and replacing them with LEDs that will be owned and maintained by the State of Montana. The affected light districts are SILMDs 97, 99 and 248. For SILMD 97, this includes 44 lights that provide illumination for four parcels (Block 19, Lots 5 and 6; Block 43, Lots 15 and 16 and Lots 17 and 19; and Block 44, Lots 7 through 9) that will need to be removed from SILMD 97. For SILMD 99, this includes seven lights that provide illumination for one parcel (Block 190, Lots 5 and 6) that will need to be removed from SILMD 99. For SILMD 248, this includes all 57 lights that provide illumination for all 59 parcels in SILMD 248 that will need to be removed, effectively discontinuing SILMD 248. A new light district is being created for the electricity and administration costs of the new lights district maintained by the State of Montana.

ALTERNATIVES
City Council may:
- Approve the resolution to amend the boundaries of SILMDs 14, 97, 99, and discontinue SILMD 248, or;
- Disapprove the resolution to amend the boundaries and discontinuance. If the boundaries are not amended for SILMDs 14, 97 and 99, several lots that do not benefit from light districts will be charged light district assessments. If SILMD 248 is not discontinued it will remain active although it does not have any street lights in it.
FISCAL EFFECTS
There is less than a three percent financial impact on the existing properties within SILMDs 14, 97 and 99. The assessments on all 59 parcels in SILMD 248 will be reduced to zero. There is no impact to the City.
