PROBLEM/ISSUE STATEMENT
The design for the construction of 6th Avenue North to Bench Boulevard Connection project has been completed. There is no existing public right-of-way on which the project is to be built, and it will be necessary to get right-of-way from two parcels. The project will be primarily constructed on Yellowstone County land located within the MetraPark campus. In addition to the County's land, there is a small temporary construction permit needed in the northwest corner of the intersection of Lake Elmo Road and Bench Boulevard. Staff has negotitated a right-of-way easement agreement with Yellowstone County (Parcel 1) and a temporary construction permit with LC Partners LLC (Parcel 2). This memo presents both agreements for the Council to act on.
ALTERNATIVES ANALYZED
The Council may:
• Approve the Right-of-Way Agreements; or
• Not approve the Right-of-Way Agreements
• Approve the Right-of-Way Agreements; or
• Not approve the Right-of-Way Agreements
FINANCIAL IMPACT
As part of the initial agreement made between Montana Department of Transportation, Yellowstone County, and the City of Billings, this land will be donated by the County as part of the local match requirements for the project. Parcel 2 requires a $1,650 payment, but this cost will be reimbursed with the project's funding. There will be no additional financial impacts associated with these agreements.
RECOMMENDATION
Staff recommends that the City Council approve the Right-of-Way Agreements for Parcels 1 and 2, and authorize the Mayor to execute the agreements.
