RECOMMENDATION
Staff recommends the City Council accept the right-of-way agreements and warranty deeds for 25, 29, 87 and 97 Hallowell Lane.
BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)
W.O. 20-30; Hallowell Lane Improvement Project, is a South Billings Urban Renewal Association (SBURA) project that will improve Hallowell Lane from State Avenue to King Avenue East. During survey of the project corridor it was determined that four properties have not dedicated right-of-way or filed road petitions for the street fronting their property. Existing property lines for those four properties currently extend to the center of Hallowell Lane. In order to complete the necessary roadway improvements of street widening, curb/gutter, sidewalk and drive approach installation, right-of-way acquisition is required.
The four properties in which right-of-way is needed are 25, 29, 87 and 97 Hallowell Lane. Properties were appraised by a certified land appraiser and all four properties accepted the appraisal and have agreed to the right-of-way conveyance and sale. The appraisals and offers were in accordance with Resolution 93-16740.

ALTERNATIVES
City Council may:
- Approve the right-of-way agreements and warranty deeds for 25, 29, 87 and 97 Hallowell Lane; or,
- Not approve the right-of-way and warranty deed agreements for all properties. If not approved, there will not be right-of-way available to construct the needed improvements.
FISCAL EFFECTS
The cost of right-of-way is $1,912.50 for 25 Hallowell Lane, $1,216.50 for 29 Hallowell Lane, $4,240.00 for 87 Hallowell Lane and $6,300.00 for 97 Hallowell Lane. The difference in price between properties is due to the amount of lot frontage being purchased, the type and size of property adjacent to the right-of-way dedication and the type of existing public services available to each property.
This project was budgeted in FY21 using South Tax Increment Funds.
