RECOMMENDATION
Staff recommends that Council approve the Resolution ordering improvements identified in WO 20-28, Songbird Drive Construction.
BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)
WO 20-28 Songbird Drive Construction will construct curb and gutter, drive approaches, sidewalks, storm sewer improvements, and pave approximately 2,400 LF of Songbird Drive, from its intersection at Midland Road to the existing asphalt section just north of Frontier Drive.
Songbird Drive is currently an unimproved City street, consisting of a gravel section from Midland Road, south approximately 600 feet. The remainder of Songbird drive is heavily rutted. City right-of-way is 80 feet wide from Midland Road to the south for approximately 600 feet. At this point, through the remainder of the project limits to the south, City right-of-way narrows to 40 feet in width and abuts the City limits to the east. The proposed road sections have been maximized through corridor as is feasible with the available right-of-way. Construction of Songbird Drive will allow the Mullowney Road improvements in FY22 to occur utilizing Songbird Drive as a second access to improve traffic accessibility.
All properties fronting the project are zoned commercial. In accordance with Resolution 18-10719, improvements may be assessed to commercial properties on the addressed and non-addressed side.
City staff sent letters to the property owners adjacent to the property limits on March 26, 2021. Participating property owners elected to have on-site meetings to discuss the general scope of the project and any property specific improvements requested on their frontages, addressed and/or non-addressed.

ALTERNATIVES
City Council may:
- Approve the Resolution ordering improvements ; or,
- Not Approve the Resolution ordering improvements. If Council does not approve the Resolution the property owners cannot be assessed and the work will not occur, leaving this section of Songbird Drive in a substandard condition.
FISCAL EFFECTS
Estimated assessments vary between properties. This is due in part to property specific characteristics, as well as property owner requested improvements.
The estimated total cost of assessed improvements for WO 20-28 is $425,000.00.
Funding is available through FY21 budgeted gas tax and property assessments.
