RECOMMENDATION

Staff recommends the City Council approve this ordinance on second reading, adding recently annexed property to Ward IV. The City Council approved first reading subsequent to a public hearing on August 23, 2021.

BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)

John and Patricia Burg submitted a petition to annex land using the provisions of Section 7-2-4600, MCA. The property is located south of Highway 3 and southeast of Rod and Gun Club Road. The property is described Tract 2-A, of Amended Tracts 1 and 2 of The Corrected Plat of Hagmann Acreage Tracts Subdivision, recorded December 16, 1983, under Document No. 1290304; Tract 1, of Certificate Of Survey No. 2577, recorded August 1, 1990, under Document No. 1568246, on file and of record in the Records of Yellowstone County. Including all adjacent rights-of-way of State Highway No. 3. and Tract 2-A, of Amended Tracts 1 and 2 of The Corrected Plat of Hagmann Acreage Tracts Subdivision, recorded December 16, 1983, under Document No. 1290304; Tract 1, of Certificate Of Survey No. 2577, recorded August 1, 1990, under Document No. 1568246, on file and of record in the Records of Yellowstone County. Including all adjacent rights-of-way of State Highway No. 3.The property contains 3.311 gross and 2.793 net acres, more or less.

Upon Council approval, this annexation requires a change in the boundaries of Ward IV. Two readings are required for this action. The first reading and public hearing was conducted and approved on August 23rd. The second reading will occur at this meeting.

STAKEHOLDERS

A public hearing was held on August 23rd. Following the hearing, the City Council approved the 1st reading.

ALTERNATIVES

City Council may:
  • Approve adding the subject property to Ward IV, or;
  • Disapprove adding the subject property to Ward IV.
Disapproval will not modify the boundary of Ward IV and will create a problem where property inside the City Limits is not within a City Ward.

FISCAL EFFECTS

This item has no impact on the Planning Division Budget.
