PROBLEM/ISSUE STATEMENT
The current Article 26-500, BMCC outlines the process for reimbursement and compensation to developers of costs of constructing certain water and wastewater facilities. Staff proposes expanding this process to include reimbursement for construction of stormwater facilities. Additionally the proposed revisions include reimbursement for construction of certain water and wastewater facilities to serve property located within the limits of annexation but outside the approved "red area" identified in the city Limits of Annexation map. These water and wastewater facilities would ordinarily be constructed by the City if serving property located within the "red area" of the map. The period over which reimbursements will be made is also proposed to be lengthened from the current 7 years to 10 years.

ALTERNATIVES ANALYZED
The City Council may 1) approve the ordinance on first reading; or 2) modify the ordinance; or 3) disapprove the ordinance.
FINANCIAL IMPACT
There is no financial impact to the City with the proposed revisions. Under the reimbursement provisions, the City assesses fees to properties seeking service, which are then rebated back to the developer less administrative charges. Reimbursements are made only if fees are assessed.
RECOMMENDATION
Staff recommends that the Council conduct a public hearing and approve the proposed ordinance on first reading.
