RECOMMENDATION

Staff recommends Council approve a resolution canceling the November 2, 2021, general election for the Mayor and Municipal Judge positions ONLY, and elect by acclamation the following:

William A. Cole, as Mayor
Sheila R. Kolar, as Municipal Judge
 

BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)

MCA 13-1-403(4) authorizes municipalities to cancel a general election for the election of a municipal officer by resolution after notification by the election administrator if the number of candidates filing for election is equal or less than the number of positions to be filled. The City of Billings received a letter from the Yellowstone County Election Administrator, Bret Rutherford, on August 30, 2021, giving notice that the elected municipal officer positions eligible for cancellation are the Mayor and Municipal Judge positions.
 

ALTERNATIVES

City Council may:
  • Approve the resolution canceling the November 2, 2021, general election for Mayor and Municipal Judge, and elect by acclamation William A. Cole as Mayor, and Sheila R. Kolar as Municipal Judge; or,
  • Not Approve the resolution canceling the November 2, 2021, general election for Mayor and Municipal Judge. If not approved, the Mayor and Municipal Judge portions will appear on the ballot.

FISCAL EFFECTS

According to the Yellowstone County Election Administrator, Bret Rutherford, removing the Mayor and Municipal Judge races would reduce the municipal election cost by approximately $5,000 - $10,000.
