Title: Public Hearing & Resolution for Nuisance Property Abatement Assessments

RECOMMENDATION

Staff recommends that the City Council conduct a public hearing and pass the attached assessment resolution.

BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)

A nuisance property abatement assessment resolution has been completed and the assessment is ready to be placed on the taxes for the following property.

309 S 28th St (A01128) - On June 1, 2021, the house on property located at 309 S 28th Street was called in as a complaint for Open Storage of Junk > 5 days – Public Nuisance and Junk Vehicles >3 – Public Nuisance.  Several notices and pictures where sent to the homeowner asking for cleanup. No clean up was made.  On November 17, 2021, Defendant did not show up for Court Hearing before Municipal Court Judge Sheila Kolar.  Judge Kolar found in favor of Code Enforcement and issued Order to Abate and Warrant of Entry on November 19, 2021.  On December 21, 2021, the abatement was completed hauling out junk and debris from the yard, blvd and alley attached to this address. No vehicles were in violation at this time.  The work was completed on time and in a satisfactory manner on December 21, 2021.  The property owner, Vilavong Keutla, was sent an invoice for the work dated January 28, 2022. The $768.43 bill remains unpaid.

ALTERNATIVES

City Council may:
  • Approve; or,
  • Not Approve, in which case the property owners will not be assessed, and the General Fund will be responsible for paying for the abatement.

FISCAL EFFECTS

The assessments total $768.43 and will reimburse the General Fund.
