PROBLEM/ISSUE STATEMENT
In January, 2005, the City Council donated lots 9-12, block 142 of the Original Town of Billings to the Montana Rescue Mission. The Mission intended to use the property as part of a new campus that would include a shelter and operations center. The donation was conditioned on development occurring within five (5) years and if it did not, the land would revert to the City (see attachment). The Mission was not able to develop the land within the time limit, so in August, 2010, the Mission conveyed the property to the City with a Grant Deed (see attachment). The City Council must accept the deed before it can be recorded. There is a companion action on this agenda; a resolution of intent to convey the property to RiverStone Health for future campus expansion.
ALTERNATIVES ANALYZED
The City Council may accept or reject the deed. If rejected, the deed cannot be recorded and that may impact the City's ability to convey or develop the property in the future.
FINANCIAL IMPACT
There is no financial impact from this action other than the customary recording fee.
RECOMMENDATION
Staff recommends that the City Council accept the Grant Deed from the Montana Rescue Mission Inc., for lots 9-12, block 142, Original Town of Billings.
