RECOMMENDATION
Staff recommends that the City Council approve the Resolution to approve the right-of-way and the Amended Plat of Lot 23-A-1 of Sunny Cove Fruit Farms.
BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)
The City of Billings owns Lot 23-A-1 of Sunny Cover Fruit Farms Subdivision located at the southwest corner of the intersection of 62nd Street West and Rimrock Road. The parcel is being used as a regional stormwater detention facility. In final design of the roundabout located at the intersection of 62nd Street West and Rimrock Road, Montana Department of Transportation (MDT) has requested a small additional right-of-way area be dedicated, of about 0.062 acres or 2,722 square feet for intersection improvements. The dedication of the right of way will not impact the operation of the stormwater facility. In advance of the roundabout being constructed, staff recommends dedicating the small amount of right-of-way. In addition, the plat notes two easements, one for storm water from the MDT constructed improvements and one for the existing irrigation pipe that supplies the Yellowstone Country Club with irrigation water from the Big Ditch. The easement to the Yellowstone Country Club provides for maintenance of the existing irrigation pipe along the edge of 62nd Street West. This resolution and associated plat will provide the necessary right-of-way for the intersection improvements. The city will continue to own and maintain the right of way after construction is complete.
ALTERNATIVES
City Council may:
- Approve the Resolution dedicating right-of-way and the Amended Plat of Lot 23-A-1; or,
- Not approve the Resolution dedicating right-of-way and the Amended Plat of Lot 23-A-1. If the amended plat is not approved, the construction of the intersection improvements at 62nd Street West and Rimrock Road will be delayed.
FISCAL EFFECTS
There are no significant financial impacts associated with approval of the resolution and amended plat.
