RECOMMENDATION
Staff recommends City Council hold a public hearing and approve the vacation of portions of Rich Lane, Will Way, and Camp Lane rights-of-way.
BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)
Legacy, LLC. has developed a portion of Legacy Subdivision. Legacy, LLC. is proposing to re-plat the remaining portion of Legacy Subdivision to be called Legacy Subdivision, 2nd Filing. The proposed plat generally consists of residential lots. The new subdivision plat includes relocated lots, added lots, and realigning the undeveloped streets. In order to move forward with the new subdivision plat, it is necessary to vacate the existing rights-of-way and a portion of the existing subdivision plat. Legacy Subdivision, 2nd Filing will dedicate new rights-of-way in place of the vacated rights-of-way. There are no improvements constructed on the portions of rights-of-way to be vacated. A map is attached showing the rights-of-way to be vacated.
In order to complete this process, three procedural items need to occur. The three procedural items include vacation of the existing rights-of-way, approval of a plat vacating the existing subdivision, and approval of a new subdivision plat dedicating new rights-of-way and lots. The vacation of the rights-of-way and the plat of the existing subdivision are done at the same council meeting, with the approval of a new subdivision plat to be at a subsequent Council meeting. The preliminary plat of the Amended Plat of Legacy Subdivision (subdivision vacation) will be presented to City Council for approval on July 11, 2022, the same meeting for the public hearing for the rights-of-way vacation. The preliminary plat for Legacy Subdivision 2nd Filing will be presented to Council for approval on July 25, 2022, and will create new lots and new rights-of-way.

ALTERNATIVES
City Council may:
- Approve the rights-of-way vacation; or,
- Not approve the rights-of-way vacation. If not approved, the developer will have to construct the original streets as platted with Legacy Subdivision.
FISCAL EFFECTS
There are no improvements constructed within the portions of the rights-of-way to be vacated. Since the existing rights-of-way are undeveloped, and there will be new rights-of-way dedicated, City Council has the option to return the rights-of-way to the developer at no cost in accordance with Administrative Order 56. In summary, there is no significant fiscal impact to vacate the rights-of-way.
