RECOMMENDATION
Staff recommends that the City Council approve the resolution adopting the revised Public Works right-of-way fees.
BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)
Public Works is proposing an updated right-of-way fee schedule and Resolution to the City Council to modify the amounts for FY23. Right-of-way fees are typically updated every 2 years so the adopted fees will be in place for FY23 and FY24. Staff has performed an analysis of the costs of administration and inspection services incurred with regards to right-of-way permits and is recommending changes to the amounts to more appropriately assign costs to the services provided. The recommended fees are based on full cost recovery principles. On average, the proposed fees represent an 8.5% increase over the fees charged in FY21 and FY22.

ALTERNATIVES
City Council may:
- Approve the resolution to update the existing fee schedule for right-of-way fees, or;
- Disapprove the resolution to update the existing fee schedule of right-of-way fees, or:
- Modify and approve the resolution to update the existing fee schedule of right-of-way fees.
FISCAL EFFECTS
The modified right-of-way fees will provide approximately $43,000 of additional revenue to the Public Works Engineering Division in FY23.
