RECOMMENDATION
Staff recommends that the City Council approve Amendment No. 3 to the City’s professional engineering services contract with Burns & McDonnell Engineering Company, Inc. (BMcD) for W.O. 19-42: West End Water Treatment Plant Project in the amount of $306,720.
BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)
Identifying and securing an alternate source of treated water for City of Billings is a priority to the Public Works Department. Through FY2023, the City has $126 million in funding budgeted to design and build the projects needed for the new water system on Billings’ west end. Over the next year, final design and start of construction is planned for a new reservoir, water treatment plant, river water intake and associated pump station, and approximately 4 miles of transmission pipeline.
In August 2019, City Council approved an $883,732 contract with BMcD for the preliminary design of the WEWTP. In April of 2021, Council approved $3,778,342 contract Amendment No. 1 to complete the final design of the WEWTP and the transmission main to connect the WEWTP to the distribution system. Amendment No. 2 for $69,278 was approved by Council in August 2021 to complete the final design of the Hesper Road gravity sewer extension and the final design of a sewer lift station and force main to serve the WEWTP.
Amendment No. 3 would add the following scope of work:
· Bidding a Zone 3 water transmission main connecting the future WEWTP to the existing distribution system and bidding a sanitary sewer trunk line extension in Hesper Road from approximately Gabel Road to the Shiloh Road roundabout.
· Membrane filter procurement and submittal review.
· Rate escalation per Appendix B, Section 4 of the contract.
· Design efforts and meetings to create additional value engineering options.
· Additional survey and geotechnical work at the new WEWTP site.

ALTERNATIVES
The Council may:
· Approve Contract Amendment No. 3 with BMcD; or
· Not approve Contract Amendment No. 3. If this project is not completed, the City will be unable to proceed with the plans needed to provide for the future drinking water capacity needs of City of Billings residents.
· Approve Contract Amendment No. 3 with BMcD; or
· Not approve Contract Amendment No. 3. If this project is not completed, the City will be unable to proceed with the plans needed to provide for the future drinking water capacity needs of City of Billings residents.
FISCAL EFFECTS
The W.O. 19-42 WEWTP Project original professional engineering services agreement with BMcD for preliminary design was in the amount of $883,732. Amendment No. 1 for final design of the WEWTP was in the amount of $3,778,342, and Amendment No. 2 for final design of the sewer main extension in Hesper Road was for $69,278. Proposed Amendment No. 3 in the amount of $306,720 would increase the total contract amount to $5,038,072. Water funds budgeted in FY23 are adequate and will be used for this project amendment.
