RECOMMENDATION

Staff recommends the City Council approve the 23rd Street Subdivision Amended SIA. 

BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)

This application is to relocate an existing sewer line that runs through Lot 1A of 23rd Street Subdivision. It is exceptionally wide, 32 feet, where utility easements in current subdivisions are 10 feet wide on the front property line. With the wide easement it reduces the buildable area of the lot. The applicant is asking to modify the SIA with new language that will reflect the utility easement being reduced to 10 feet and moved to the back of the property line. The existing sewer line will be relocated to the new easement.  Below is a short narrative of events leading to this application request. 
 
  • IMEG / Territorial Landworks completed the initial 23rd Street Subdivision in 2015 and attached is the plat from prior to that time, see attachment 'Original Plat'. These documents show no easement existed on the parcel outside the ROW and all utilities are located within the existing ROW.
  • In 2015 when IMEG / Territorial Landworks split Lot 1A it was determined that the existing sewer service on the lot was located approximately 30 feet inside the ROW, so a 32-foot easement was platted for this existing sewer service.   See attachment 'recorded 2015 plat'.
Now that lot 1A is planning to build, they are going to relocate that sewer service closer to the ROW so that there is more buildable space on the parcel. IMEG is proposing to reduce the current 32-foot easement down to a 10-foot easement.  See attachment 'proposed easement exhibit'.

Attached to this report is also a redline edition of the SIA showing what is proposed to be changed. The final attachment is the SIA that is to be recorded should this action be approved. The final version includes the new Waiver of Right to Protest language.

ALTERNATIVES

The City Council may approve, conditionally approve or disapprove the proposed SIA amendment for 23rd Street Subdivision.

FISCAL EFFECTS

The final plat of this subdivision will have no financial impact on the Planning Division.
