RECOMMENDATION
Staff recommends that the City Council approve Amendment No. 3 to the City’s professional engineering services contract with HDR Engineering, Inc. (HDR) for W.O. 19-21: WRF Influent Lift Station Project in the amount of $190,600.
BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)
In April 2019, City Council approved a $115,700 contract with HDR for preliminary design of the WRF Influent Lift Station. In December of 2019, Council approved $649,400 contract Amendment No. 1 to complete the project’s final design, bidding and construction administration phases. Amendment No. 2 for $73,400 was approved by Council in October 2021 to coordinate the design of the concurrent Interceptor Replacement Project with the WRF Lift Station Project and make some associated design, bidding and post-bid modifications. Construction began in May 2021 and anticipated completion is in October 2022.
Amendment No. 3 provides for:
· Out-of-scope construction administration and observation services for an estimated 310 days of construction contract time beyond the project substantial completion date of October 15, 2022. The primary cause of this delay to completion has been the evaluation, testing, cure times, and replacement of low-strength concrete supplied to the project.
· Out-of-scope engineering, construction contract administration and construction observation services for contractor-caused project issues during construction.
The City has been and will continue to assess liquidated damages on the contractor’s payment applications to recover these out-of-scope fees.

ALTERNATIVES
The Council may:
· Approve Contract Amendment No. 3 with HDR; or
· Not approve Contract Amendment No. 1. If this amendment is not approved, HDR will not be reimbursed for the out-of-scope engineering services necessary to complete the influent lift station project.
· Not approve Contract Amendment No. 1. If this amendment is not approved, HDR will not be reimbursed for the out-of-scope engineering services necessary to complete the influent lift station project.
FISCAL EFFECTS
The W.O. 19-21: WRF Influent Lift Station Project original professional engineering services agreement with HDR for preliminary design was in the amount of $115,700. Amendment No. 1 for final design, bidding and construction administration was in the amount of $649,400, and Amendment No. 2 for required design changes was for $73,400. Proposed Amendment No. 3 in the amount of $190,600 (recoverable from the contractor through assessment of liquidated damages) would increase the total contract amount to $1,029,100. Wastewater funds budgeted in FY 23 are adequate and will be used for this project amendment, but the actual cost will be recovered from the construction contract liquidated damages, resulting in no net cost to the City.
