Staff recommends the City Council approve this ordinance on second reading, adding recently annexed property to Ward IV. Council conducted a public hearing and approved this ordinance on first reading on October 24.

Sanderson Stewart on behalf of Steve Michelotti submitted a petition to annex land using the provisions of Section 7-2-4600, MCA. The property is located South of Avenue D and East of Tiburon Lane. The land being annexed is described as being Tract 2B, Certificate of Survey No. 2974, Amended Tract 2, recorded November 26th, 2012, under Document No. 3647208; also Including all Right-Of-Way of Avenue D within proposed Michelotti Subdivision. Said annexation containing 7.000 gross and net acres, more or less.

Upon Council approval, this annexation requires a change in the boundaries of Ward IV. Two readings are required for this action. The first reading and public hearing was held October 24, 2022 and approved by the Council. The second reading will occur at this meeting. 

City Council may:

• Approve adding the subject property to Ward IV, or;
• Disapprove adding the subject property to Ward IV. Disapproval will not modify the boundary of Ward IV and will create a problem where property inside the City Limits is not within a City Ward.

This application has no impact on the Planning Division Budget.
