RECOMMENDATION
Staff recommends that City Council accept the utility right-of-way easement from James and Joann Boyer.
BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)
James and Joann Boyer own a portion of Terrace Estates Subdivision, 3rd Filing which was de-annexed from the City in 2017. Terrace Estates Subdivision, 3rd Filing is located off of Alkali Creek Road west of Senators Boulevard. There is an existing City storm drain and sanitary sewer main that goes through previously platted right-of-way. The Boyers have vacated a portion of the subdivision along with the right-of-way through the County. Per State law, the City retains access to the storm drain and sanitary sewer lines. However, the City requested a formal easement with the Boyers for the existing utilities.
ALTERNATIVES
The City Council may:
- Approve the utility right-of-way easement; or
- Not approve the easement. The City would still retain the right to access and maintain the storm and sanitary sewer mains through the vacation process. The easement is at the request of the City.
FISCAL EFFECTS
There is no cost to the City for acceptance of the easement.
