RECOMMENDATION
Staff recommends that City Council award a contract for WO 23-02: 2023 Missing Sidewalk Project, Schedules 1 and 2 to J & J Concrete, Inc. and Schedules 3 through 6 to Askin Construction for a total of $942,009.
BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)
The Missing Sidewalk/Miscellaneous Concrete project is intended to concentrate on installing sidewalk in areas that are missing pedestrian facilities. As a priority, City staff identified missing sidewalk in areas along arterial streets, collector streets, school routes (as identified in the Safe Routes to School Plan), or in high pedestrian areas for inclusion in this program. The streets identified as missing sidewalk are Virginia Lane from Rimrock Road to Poly Drive, Alkali Creek Road from Moon Beam Lane to North Moon Beam Lane, Avenue C from 24th Street West to 22nd Street West, 21st Street West from Grand Avenue to Avenue D, 12th Street West from Grand Avenue to Lewis Avenue, and Parkview Drive from Broadwater Avenue to Lillis Lane.
The project was split into the following bid schedules:
Schedule I: Virginia Lane, Schedule 2: Alkali Creek Road, Schedule 3: Parkview Drive, Schedule 4: 21st Street West, Schedule 5: Avenue C, and Schedule 6: 12th Street West. Contractors were given the option to bid on any combination of schedules. The specified construction schedule was flexible, giving contractors until November 15th, 2023 to complete the project. Separating bid schedules and providing flexible completion time allowed multiple contractors (large and small) to bid on the work and obtain the lowest bids possible.
The project was advertised on November 4, November 11, and November 18, 2022, in the Yellowstone County News and on the City's website. Bids were opened on November 22, 2022 and four bids were received. J & J Concrete, Inc. submitted the lowest, responsible bid for Schedules 1 and 2. Askin Construction submitted the lowest, responsible bid for Schedules 3 through 6, inclusive.

ALTERNATIVES
City Council may:
- Award WO 23-02 Schedules 1 and 2 to J & J Concrete, Inc. and Schedules 3 through 6 to Askin Construction, contingent on Council ordering in improvements via resolution
- Award any combination of schedules, contingent on Council ordering in improvements via resolution
- Reject any schedules or all bids. Rejecting certain schedules or all bids will leave areas of missing sidewalk that are key to maintaining continuous pedestrian connections.

The project was budgeted in FY23 using Gas Tax funds and Assessments. There is sufficient budget to award the project.
