RECOMMENDATION
Staff recommends that City Council accept the perpetual right-of-way easement from First Southern Baptist Church.
BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)
The First Southern Baptist Church (Emmanuel Baptist Church) owns Tract 1, COS 3358. This property is located on the northwest corner of the Shiloh Road and Rocky Vista Way intersection. The City is proposing to extend a sanitary sewer main to the west along the southern boundary of the property. This trunk sewer, which is being designed and constructed under WO 23-07, will continue further west toward 48th Street West, providing gravity sewer service west of Shiloh Road between King Avenue and Central Road. The sewer main extension project is planned for construction in FY24. The perpetual right-of-way easement will allow for construction and maintenance of the sanitary sewer system.
ALTERNATIVES
City Council may:
- Accept the perpetual right-of-way easement; or,
- Not accept the easement. If the easement is not accepted, the City would not be able to construct the sanitary sewer in the planned location.
FISCAL EFFECTS
There is no cost to the City for acceptance of the easement.
