RECOMMENDATION

Staff recommends the City Council award a construction contract to K2 Civil, Inc. for W.O. 22-47: Landfill Slope Stability Improvements, in the amount of $878,375 for the Base Bid, Alternate No. 1, and Alternate No. 2.

BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)

The north slope of the Billings Regional Landfill, west of the Landfill entrance and above Jellison Road, experienced failures in 2018, causing damage to private property north of Jellison Road.  The City subsequently had a hazard assessment and alternatives analysis performed, which led to a mitigation project that commenced in July, 2020.  The mitigation primarily involved removing the majority of overburden material, regrading to more gradual slopes, and revegetating the affected areas.  The project ended with final seeding in November, 2020.

The north slope that is east of the main Landfill entrance showed signs of sloughing in December, 2021, and again in May, 2022.  The material that moved downslope did not cause any damage, but there is private property below this slope that could be affected if the slope were to fail.  Solid Waste staff removed some material from the top above this slope in the spring of 2022, but more extensive mitigation is required.  W.O. 22-47 provides the additional mitigation, similar to what was implemented in the initial project for the slope west of the main entrance.  For bidding purposes and to maximize the use of available funds, the project was broken into three areas: the farthest east section, above private property, includes 89,405 cubic yards of earthwork, has been deemed to have the highest priority and is classified as the Base Bid; a middle section, immediately west of the Base Bid area, includes an additional 15,595 cubic yards of earthwork, and is classified as Alternate No. 1; and the furthest west section, immediately east of the Landfill entrance and above Solid Waste's old maintenance shop, includes another 25,000 cubic yards of earthwork and is classified as Alternate No. 2.  This project is a planned Solid Waste CIP project, budgeted for FY24.

The project was advertised on April 21 and 28 and May 5 and 12, 2023, in the Yellowstone County News and on the City's website.  Bids were opened on May 16, 2023, and four bids were received.  K2 Civil, Inc. submitted the lowest responsible bid.  The low bid, including the Base Bid, Alternate No. 1 and Alternate No. 2, is below the Engineer's estimate and is within the approved budget.

ALTERNATIVES

City Council may:
  • Award a construction contract to K2 Civil Inc. for the Base Bid, Alternate No. 1, and Alternate No. 2 in the total amount of $878,375; or
  • Not award a contract and reject all bids.  If the bid is not awarded, the slope stability mitigation will be further delayed, leaving the potential for slope failure and possible property damage.

The project was budgeted in FY24 using Solid Waste funds in the amount of $900,000.  There are sufficient funds available to award this contract.
