RECOMMENDATION

Staff recommends the City Council award a General Contractor-Construction Manager (GC-CM) Pre-Construction Services Contract for W.O. 22-37, Landfill Drop-Off Building Repairs, to Swank Enterprises in the amount of $42,100.
 

BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)

The City of Billings completed a project in February 2021, that included a new drop-off building.  The drop-off building is a 60,000 square-foot pre-engineered metal building (PEMB) used by customers as a facility to drop off garbage to be landfilled by City staff.  A fire occurred in the west end of the building on January 19, 2022, causing substantial damages that have prevented the City from resuming operations inside the building.

On March 14, 2022, Council approved a Resolution allowing the use of an Alternative Method of Delivery -- General Contractor-Construction Manager (GC-CM).  The City publicly advertised and solicited proposals for GC-CM services to collaborate with HDR Engineering (the City's consultant for professional services) in assessing the extent of repairs needed to make the drop-off building operational.  Additionally, the GC-CM firm will assist with the creation of a scope of repairs that is acceptable to the City's insurance group, perform cost estimating, perform constructability reviews, review early procurement of materials, develop the project schedule, and ultimately perform the repair work.

Three general contractor companies expressed interest in the project and the City received one proposal from Swank Enterprises.  Swank was the general contractor on the original project that constructed the entire Landfill Drop-Off Facility, new Maintenance Building, and new Scale Plaza.  Swank was selected based on their qualifications, including Project Team and Capability, Strategic Project Approach, Approach to CM-GC Project Delivery Method, and a Construction Multiplier.  This initial contract includes only pre-construction services, as included in the RFP and summarized above.  Construction services are not included in this contract and will be included in a separate contract in the future when the construction scope of work and associated plans and specifications are finalized. 

ALTERNATIVES

Council may:
· Award W.O. 22-37, Landfill Drop-Off Building Repairs GC-CM Pre-Construction Services contract, to Swank Enterprises in the amount of $42,100; or
· Not award a contract for GC-CM pre-construction services.  This would negatively impact the City’s ability to complete repairs on the drop-off building allowing it to be put back into operation, which would then negatively impact solid waste operations.

FISCAL EFFECTS

This project will utilize Solid Waste funds and insurance claim reimbursements.  The City has received an advanced partial insurance reimbursement of $750,000.
