Staff recommends that the City Council approve the corrected Annexation Agreement with Billings South Shiloh, LLC.

At the April 25, 2022, Council meeting, City Council approved the annexation of Certificate of Survey 1100 Amended, Tract C.  Subsequently, at the May 23, 2022, Council meeting, City Council approved the Annexation Agreement with Shiloh Farm, LLC. for this same parcel of land.  Prior to executing the Annexation Agreement, Shiloh Farm, LLC., sold the property to Billings South Shiloh, LLC, and is requesting the new owner execute the Annexation Agreement.  In order for the Annexation Agreement to be changed to reflect the new ownership, it is necessary for City Council to approve the change.  Except for the ownership, nothing in the Annexation Agreement has changed from the agreement approved by Council at the May 23, 2022, meeting.  Attached is the original agreement approved on May 23, 2022 and the corrected agreement reflecting the new ownership name.

City Council may:

• Approve the corrected Annexation Agreement with the property owner; or
• Not approve the corrected Annexation Agreement.  If the agreement is not approved, the applicant will not meet the conditions of annexation, which requires an Annexation Agreement be approved within 45 working days of annexation.  

There is no significant financial impact associated with the approval of the corrected Annexation Agreement.
