RECOMMENDATION
City staff recommends the City Council approve the exempt plat of Amended Plat of Lot 9A , Block 1, Gabel Subdivision, 1st Filing.
BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)
On May 15, 2023, Sanderson Stewart submitted an exempt plat to the City Planning Division to relocate the controlled access location of the lot. The subject property is generally located on the northwest corner of the intersection of Hesper Road and 32nd Street West. City Public Works and the Engineering Division has reviewed and approved the relocation. The Mayor does not typically sign exempt surveys, but because of the controlled access being relocated, it requires the Mayor's signature for that process to take place. The request is for the City Council to agree to the relocation of the controlled access. The exempt plat has been reviewed and approved by City Staff and meets the requirements of the exempt plat process outlined in the Montana Subdivision and Platting Act. These documents are appropriate as to form for filing with the Clerk and Recorder.
STAKEHOLDERS
A public hearing is not required for exempt plats as they are exempt from subdivision regulations as they are minor changes to lots. However, the City Council meeting is public and members of the public may attend the meeting and speak on this item during the appropriate public comment period.
ALTERNATIVES
City Council may:
- Approve the exempt plat for Amended Plat of Lot 9A, Block 1, Gabel Subdivision, 1st Filing, or;
- Disapprove the exempt plat. If the exempt plat is not approved, the developer will have to utilize the existing access points.
FISCAL EFFECTS
The final exempt plat of this subdivision will have no financial impact on the Planning Division.
