PROBLEM/ISSUE STATEMENT

The final plat for Grand Peaks Subdivision, 2nd Filing is being presented to Council for approval. On November 22, 2010, the City Council conditionally approved the replatting of 5 lots originally platted in the Grand Peaks Subdivision and Bishop Fox Subdivision into 77 lots. Since that time, the subdividers have requested that only a portion of the original proposal be platted and are requesting final plat approval for 35 lots on 9.2 acres. Since no changes to the original lot layout are proposed, staff has determined this is a minor adjustment to the plat (in accordance with Section 23-1104.A., BMCC), and it does not have to return for preliminary plat review. The subject property is located at the intersection of 54th St. West and Castle Stone Square, just north of Grand Avenue. The property is zoned Residential-7000. The owner is Bishop Fox Company, the subdivider is J&S Development, Jeff Junkert, President, and the representing agent is Sanderson Stewart.

The Planning Division and other applicable City Departments have reviewed this final plat and find that the plat and supporting documents conform to the conditions of preliminary plat approval and comply with MCA 76-3-611 and BMCC Section 23-307. Upon City Council approval, the plat and supporting documents are appropriate as to form for filing with the Clerk and Recorder.

ALTERNATIVES ANALYZED

The City Council may approve or deny the final plat of Grand Peaks Subdivision, 2nd Filing. If the City Council chooses to deny the final plat, it must base the denial on the criteria outlined in MCA 76-3-611 and BMCC Section 23-307.

FINANCIAL IMPACT

Should the City Council approve the final plat, additional residences will be built on the property and will result in increased tax revenues for the City.

RECOMMENDATION

Staff recommends that the City Council approve the final plat of Grand Peaks Subdivision, 2nd Filing.
