RECOMMENDATION
Staff recommends Council approve the second and final reading of the Ordinance amending BMCC, Article 21-200, Solid Waste Collection and Disposal.
BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)
At its meeting on July 24, 2023, the City Council conducted a public hearing and approved first reading of an ordinance amending Article 21-200 of the Billings Montana City Code including the following:
- Revising the service for "extras" collection to cardboard only as approved by Council at the June 26, 2023, business meeting;
- Defining the parameters of additional collection services as an on-call, per fee basis;
- Specifying acceptable cardboard guidelines;
- Removing the $500 permit fee for infectious wastes from city code and instead including the fee in the annual solid waste rate resolution;
- Specifying that a residential collection customer can have up to two residential black containers and up to two yard waste containers;
- Allowing for residential customers to have either a 64 gallon or 96 gallon containers and designating that a customer with a 64 gallon container cannot have a second black container;
- Requiring that all trash placed in black residential containers be bagged and tied;
- Specifying that lids on residential containers should be able to close and overfilled containers will not be emptied;
- Defining the allowable time period that residential containers can be set out in the city right-of-way as the night before and day of solid waste collection;
- Adding verbiage regarding the illegal dumping of solid waste;
- Revising the unsecured load language to include the uncovered load fee;
- Adding parameters for disposal of contaminate material and asbestos;
- Including information regarding delinquent bill procedures;
- Deleting and revising obsolete language; and
- Adding definitions and making other minor changes to verbiage.
- Move the verbiage specifying that residential customers in subdivisions without available on-site storage for yard waste containers will not be provided yard waste containers from Section 21-205, Yard waste to Sec 21-207, Solid waste containers;
- Revise Sec. 21-211(g) to clarify that when stating that containers may not be left in right-of-ways outside the allowable time, it pertains to street right-of-way and not alley right-of-way; and
- Revise Sec. 21-204 to use the word "flammable" in all instances in which "inflammable" was previously stated.
ALTERNATIVES
City Council may:
- Approve the amendment to BMCC, Article 21-200 Solid Waste Collection and Disposal; or,
- Not approve the amendment.
FISCAL EFFECTS
There are no significant fiscal effects as a result of this amendment to city code.
