RECOMMENDATION

Staff recommends that City Council accept the Perpetual Right-of-Way Easements from Sisters of Charity of Leavenworth Health Services Corporation (St. Vincent's Healthcare) et al.

BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)

As part of the construction of the new hospital, St. Vincent's Healthcare will be required to relocate the water main, sanitary sewer main and storm drain main.  Currently, the water, sanitary sewer, and storm drain mains are located in the areas that were previously vacated where the new hospital will be located.  Attached is an exhibit showing where the utilities will be relocated to.  City staff has reviewed the new routes for the utilities and the utilities will be accessible for the City to maintain.  Except for a small portion of the water main, the utilities will be located outside of North 27th Street which avoids major construction within North 27th Street.  St. Vincent's Healthcare has agreed to grant the City four separate easements for the relocation of the utilities. The easements will allow the City perpetual access to maintain the water, sanitary sewer, and storm drain mains.

ALTERNATIVES

City Council may:
  • Approve the easements; or,
  • Not Approve the easements.  If the easements are not approved, the developer will have to relocate the utilities in public right-of-way which will causer greater disruption to the public when mains are constructed and maintained.

FISCAL EFFECTS

There is no cost to the City for acceptance of the easements.
