Staff recommends Council accept the Memorandum of Understanding between Annafeld Homeowners Association and the City of Billings. 

Annafeld Parks Maintenance District # 4041 was created to maintain the City Parkland within Annafeld subdivision and assess the property owners for those services. The Homeowners' association has expressed an interest in taking over the maintenance of the City parkland within the subdivision. The HOA already contracts to maintain the private parkland within the subdivision and desires a higher level of care than the Parks Department can deliver. The MOU ensures a minimum level of maintenance and that all will be followed. The MOU provides protection for the park users and residents by requiring licensed and insured pesticide applicators and that the maintenance company chosen by the HOA would also be insured. The playground and electrical service would remain the City's responsibility for which the PMD would be assessed.

City Council may:

• Approve the Memorandum of Understanding between the Annafald Homeowners Association and the City of Billings Parks Department; or,
• Not Approve the Memorandum of Understanding.

The Annafeld PMD #4041 would not be assessed for the Parks Charge for Services and Grounds Maintenance portion of the FY2025 assessments. This would be approximately $23,400 dollars less assessed charges to the General fund.
