RECOMMENDATION

Staff recommends that the City Council approve the release of the Perpetual Right-of-Way Easement recorded as document number 4057949.

BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)

The Perpetual Right-of-Way Easement (document number 4057949) was acquired by the City for sanitary sewer installation for the Monad Sewer Extension project. The easement crosses through Tract 2A-1 of the Amended Plat of Tract 2A of Certificate of Survey 2063, which is currently being developed as the Farmstead Apartments. The easement was obtained at no cost to the City in order to complete the Monad Sewer Extension project.  After the easement was acquired, a separate easement was acquired along the preferred and more cost-effective alignment for construction of a future sewer extension to 48th Street West.  As a result, no sanitary sewer main was installed on Tract 2A-1 of COS 2063.  Additionally, no existing public utilities are located within this easement to be released and there are not any planned public utilities within this easement.  Attached is the easement (as an exhibit to the release) to be released that is no longer needed for public utilities, highlighted in yellow. This Council action is to approve the release of this easement.

City Council may:
  • Approve the release of the easement; or,
  • Not approve of the release.

FISCAL EFFECTS

There is no significant fiscal effect resulting from the approval of the release of the easement.
