RECOMMENDATION
Staff recommends that City Council accept a perpetual right-of-way easement from Patterson Land & Livestock Co. for construction of the Briarwood Boulevard 16-inch Water Main Extension.
BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)
Patterson Land & Livestock Co. owns Tract 1, COS 2218 which is located in Briarwood Subdivision adjacent to and on the south side of Briarwood Boulevard. The City is proposing to extend a water main inside the northern boundary of the property to complete the transmission main in Briarwood Boulevard between Turnberry Circle and McMasters Road. The current transmission main is the only feed into Briarwood Subdivision and reservoir, and this new section of water line would shift the transmission line out of Rosemont Way, which is a residential street containing many water services. Furthermore, construction of the water main creates redundancy to serve the subdivision. Relocation of the transmission main out of Rosemont Way and into Briarwood Boulevard facilitates future replacement of the water line in Rosemont Way as well as other aging residential water lines in the subdivision. Construction of this transmission main was included in the FY24 CIP.
A 50-foot wide easement approximately 1315 feet long totaling 1.51 acres would be acquired. Approximately 20 feet in width is needed to include an easement for Briarwood Boulevard to its centerline, and 30 feet is needed off the southern edge of the road for construction and future maintenance of the water line. Compensation of $21,900 for the permanent easement area has been agreed to by Patterson Land & Livestock Co. based on a restricted-use appraisal of the property conducted by Thomas Appraisal Services.

ALTERNATIVES
City Council may:
- Accept the perpetual right-of-way easement and agree to compensate for the permanent easement in the amount of $21,900; or,
- Not accept the easement. If the easement is not accepted, the City would not be able to construct the transmission main in the preferred location.
FISCAL EFFECTS
The cost of the permanent easement is $21,900 and included in the FY24 Water budget.
