The City Staff recommends that the City Council adopt the resolution establishing a $20.00 administrative fee per violation for failure to pay for a parking violation by the timeframe indicated in Section 24-1004 of the BMCC.

Article 24-1000 of the Billings, Montana City Code (BMCC) had not been reviewed or amended since approximately 1993; some sections have been longer.   The City Parking Division recommended revisions to a number of sections, including 24-1004 Parking violation - Procedure generally.  The first Ordinance Amendment reading was approved by City Council on August 12, 2024.  On August 26, 2024, the second/final Ordinance Amendment was approved by City Council, with an amendment to Sec.1004 (C)1 and (D).  A member of City Council suggested the amount of the administration fee be removed from the Ordinance and moved to Resolution No. 23-11168.

  The $20 administration fee per violation should encourage individuals to either pay or contest their violations in a timely manner. The city will be monitoring potential changes in the fiscal effects.
