RECOMMENDATION

Staff recommends the City Council approve this ordinance on second reading adding recently annexed property to Ward I. Council held a public hearing on October 14, 2024 and recommended approval on first reading. This second reading action would be consistent with the first reading.

BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)

Mimi Wolok on behalf of Montana Department of Military Affairs submitted a petition to annex land using the provisions MCA 7-2-4600. The property is located north of Highway 3 and west of AJ Way. The land being annexed is described as being that part of E ½ NW ¼ , SW ¼ NE ¼  and NW ¼ SE ¼ of Section 26, Township 1 north, Range 25 east, of the Principal Montana Meridian, in Yellowstone County, Montana, described as Tract 4 and Tract 5 of Certificate of Survey No. 1889 on file in the office of the Clerk and Recorder of said County, under Document No. 1129245; and That part of SW ¼ NE ¼ and NW ¼ SE ¼ of Section 26, Township I North, Range 25 East, of the Principal Montana Meridian, in Yellowstone County, Montana, described as Tract 6A and 6B of Certificate of Survey No. 1889AM, amending Tract 6 of Certificate of Survey No. 1889, on file in the office of the Clerk and Recorder of said County, under Document No. 364410. Said annexation contains 78 gross acres more or less.

Upon Council approval, this annexation requires a change in the boundaries of Ward I. Two readings are required for this action. The first reading and public hearing occurred October 14th. The second reading will occur at this meeting.
 

STAKEHOLDERS

City Council conducted a public hearing and first reading on October 14, 2024. The City Council received no testimony from the public, and closed the public hearing. The City Council did not have any further discussion. Council Member Shaw made a motion to approve the annexation on first reading and adopt the findings of the annexation criteria. The motion was seconded by Council Member Gulick and unanimously approved 11-0.

ALTERNATIVES

City Council may:
  • Approve adding the subject property to Ward I, or;
  • Disapprove adding the subject property to Ward I. Disapproval will not modify the boundary of Ward I and will create a problem where property inside the City Limits is not within a City Ward.

FISCAL EFFECTS

This application has no impact on the Planning Division Budget.
