RECOMMENDATION

Staff recommends that City Council accept the Public Sidewalk Easement from Tanner and Jennifer Bennion, the owners of Lots 20 and 21, Block 2, Rim Point Subdivision.

BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)

The development of Lots 20 and 21, Block 2 in Rim Point Subdivision requires a sidewalk easement due to space required for the public sidewalk and a drainage swale along the lot frontage of Toyon Drive.  The drainage swale occupies most of the right-of-way, which requires additional space for the sidewalk.  The property owner constructed the sidewalk within the easement area. The sidewalk provides a continuous ADA path around the cul-de-sac.  For reference, Lots 20 and 21 of Block 2, Rim Point Subdivision have been forever merged by merger deed No. 4042977 and are both owned by Tanner and Jennifer Bennion.  This council action is to approve the easement for the public sidewalk.

ALTERNATIVES

City Council may:
  • Accept the Public Sidewalk Easement; or,
  • Not accept the Public Sidewalk Easement.  If the easement is not accepted, the public sidewalk that is in place will be on private property with no easement providing for public use.

FISCAL EFFECTS

There is no significant financial impact to the City with acceptance of the Public Sidewalk Easement.
