RECOMMENDATION
Staff recommends that the City Council acknowledge the receipt of the petition to vacate right-of-way consisting of the carriage lane located in Block 31 of Annafeld Subdivision, Fifth Filing and set a public hearing for May 27th, 2025.
BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)
McCall Development, the developer of Annafeld Subdivision, requested to vacate right-of-way consisting of a carriage lane (alley) between Lot 5 and Lot 6, Block 31 in Annafeld Subdivision, Fifth Filing. The right-of-way area is 0.058 acres. Annafeld Subdivision, Fifth Filing was platted in July 2024. McCall Development is replatting the adjacent lots with Seventh Filing, which makes the right-of-way and carriage lane unnecessary. There have been no improvements made to the portions of right-of-way to be vacated and the public has no cost basis in the right-of-way. McCall Development is the original developer. Therefore, the right-of-way to be vacated can be returned at no cost to the adjacent property from which it was originally dedicated in accordance with Administrative Order 56. The resolution with a map showing the right-of-way to be vacated and Administrative Order 56 are attached.
The Council action is to acknowledge the receipt of the petition to vacate public right-of-way.

ALTERNATIVES
City Council may:
- Acknowledge receipt of the petition to vacate the above-mentioned right-of-way and set a public hearing for May 27th, 2025; or
- Do not acknowledge the petition to vacate the right-of-way. If the petition is not acknowledged, the right-of-way vacation cannot proceed.
FISCAL EFFECTS
There is no significant fiscal effect to acknowledge receipt of the petition and set a public hearing.
