Title: Public Hearing to Vacate an Alley Within Block 31 of Annafeld Subdivision, Fifth Filing

RECOMMENDATION

Staff recommends the City Council hold a public hearing and approve the vacation of an alley (carriage lane) within Block 31 of Annafeld Subdivision, Fifth Filing.

BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)

McCall Development, the developer of Annafeld Subdivision, has requested vacation of the alley (carriage lane) between Lot 5 and Lot 6, Block 31 in Annafeld Subdivision, Fifth Filing.  Annafeld Subdivision, Fifth Filing was platted in July of 2024. McCall Development is replatting the adjacent lots with Seventh Filing, which makes the carriage lane unnecessary. There have been no improvements made to the portions of right-of-way to be vacated. McCall Development is the original developer. Therefore, the right-of-way to be vacated can be returned at no cost to the developer in accordance with Administrative Order 56.  Attached is the resolution with a map showing the right-of-way to be vacated.  One benefit to this vacation is that there will be less street to maintain without the alley.

ALTERNATIVES

City Council may:
  • Approve the right-of-way vacation; or,
  • Not approve the right-of-way vacation. If not approved, McCall Development will have to reconfigure the plat for Annafeld Subdivision, Seventh Filing utilizing the existing right-of-way.

FISCAL EFFECTS

Administrative Order 56 states that since the right-of-way proposed to be vacated will revert to the original developer and no improvements are constructed, there is no cost for the vacation. The adjacent lots will be re-platted with Annafeld Subdivision, Seventh Filing. In summary, there is no fiscal effect with this action.
