PROBLEM/ISSUE STATEMENT
At the May 9, 2011, City Council meeting, Council passed the Resolution of Intent to Create SILMD 308. SILMD 308 is a street light district which will pay for the ownership, energy, and maintenance cost for the street lights within Phase II of Chrysalis Acres Subdivision. This will be a NorthWestern Energy owned and operated lighting district. The Resolution of Intent also established a public hearing for creation of the proposed district for the June 13, 2011, Council meeting. Legal notices and a letter explaining the district and all protest procedures were mailed to each of the landowners in the proposed new district on May 19, 2011. Information on the number and percentage of property owner protests received will be presented at the public hearing. SILMD 308 was created on a square footage of property that is within the district boundaries as detailed in the Resolution of Intent. The assessments to each property within the district are based on decorative high-pressure sodium lights. There are 33 properties within the district, with an average yearly assessment of $97.32. The largest yearly assessment is $197.64, and the smallest yearly assessment is $79.98.
ALTERNATIVES ANALYZED
The Council may:
- Pass the Resolution Creating SILMD 308 - Chrysalis Acres Subdivision, Phase II; or
- Do not pass the Resolution Creating SILMD 308, leaving the area without lighting.
FINANCIAL IMPACT
All ownership, energy, and maintenance costs for this proposed light district will be paid for by assessments on properties within the district.
RECOMMENDATION
Staff recommends that Council pass this Resolution Creating SILMD 308.
