RECOMMENDATION

Staff recommends that Council approve amendment 1 to the Park 1 3rd Ave N Garage Condo Declaration. 

BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)

The purchaser of the Subject Property, TD Properties and/or assigns, has requested that Section 15 of Condo Declaration be amended to add the words "and their Tenants" to the last sentence in Section 15. This is one of the items included in the contingency notice from the Buyer. This language modifies the benefits of just Condo Association Ownership to Condo Association Ownership and their Tenants.

The immediate financial impacts include the cost of Moulton Bellingham reviewing the proposed change and drafting the amended Condo Declaration.
