Title: Acceptance of Warranty Deed for Lot 4B, Annafeld North Subdivision 1st Filing from McCall Development

RECOMMENDATION

Staff recommends that City Council accept the warranty deed from McCall Development for Lot 4B of Annafeld North Subdivision 1st Filing, Block 3, to create a public right-of-way.

BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)

McCall Development has proposed an exempt plat that rearranges 5 lots within Annafeld North Subdivision 1st Filing, Block 3.  With this plat, Lot 4B was created as a public carriage lane (public right-of-way) that will connect to future development located immediately west.  In order to create the public carriage lane, it is necessary to complete a warranty deed that deeds Lot 4B to the City.  Carriage lanes are consistent with the adjacent development and a similar carriage lane was dedicated to the public just to the east of St. George Boulevard.  Attached is a copy of the warranty deed and the exempt plat, highlighting the area of the proposed right-of-way dedication and the similar area to the east of St. George Boulevard.

ALTERNATIVES

City Council may:
  • Approve the warranty deed; or,
  • Not approve the warranty deed.  If not approved, the exempt plat cannot be approved, and the carriage lane would remain private.  

FISCAL EFFECTS

There is no significant financial impact to the City with acceptance of the warranty deed.
